PRIVACY POLICY

In accordance with law n°78-17 of January 6, 1978, relating to data protection, files, and freedoms, as amended, each member has the right to access and rectify the personal information concerning them, which Shala Omm may process for exclusively commercial purposes. The member may exercise their right of access, opposition, and rectification by email, at the address: hello@shalaomm.com. The member also has the option, under the same conditions, to object to the use of their personal data from the moment of registration, as well as to consent or object to their use for commercial communication purposes, in accordance with the choice of checkboxes made during the purchase of a service. This automated processing of information has been declared to the CNIL (Commission Nationale de l’Informatique et des Libertés), registration number pending.

INTELLECTUAL PROPERTY

All elements of the Site, whether visual or auditory, including the underlying technology, are the exclusive property of Shala Omm and are protected by copyright or trademark law. Any member who has a website and wishes to place a simple link directly to www.shalaomm.com must obtain prior written authorization from Shala Omm.

APPLICABLE LAW AND JURISDICTION

All the clauses contained in these general conditions, as well as all the operations mentioned therein and any dispute or litigation that may arise from an order or its consequences, shall be subject to French law and its courts under the conditions of common law. If one or more provisions of these general conditions are held to be invalid or declared as such under the application of a law, regulation, or following a court decision, the other provisions shall remain in full force and effect.

The member is informed that he/she may, in any case, resort to prior conventional mediation before any legal action, in particular with the Consumer Mediation Commission (in accordance with Article L.612-1 of the Consumer Code) or with existing sectoral mediation bodies, or any alternative method of dispute resolution (such as conciliation) in case of dispute.

PRECONTRACTUAL INFORMATION AND ACCEPTANCE OF THE MEMBER

The member acknowledges that he/she has been provided with clear and understandable communication, prior to the immediate purchase of a service or placing an order, of the present General Terms and Conditions and all the information listed in Article L. 221-5 of the Consumer Code, including the essential characteristics of the services.

Provided by Shala Omm; the price of the courses and additional fees; in the absence of immediate execution of the contract, the date or deadline by which Shala Omm undertakes to provide the purchased courses; information regarding the identity of Shala Omm, its postal, telephone, and electronic contact details, and its activities; information regarding legal and contractual warranties and their terms of implementation; the functionalities of the digital content and, if applicable, its interoperability with other software in connection with the use of personal data; the possibility of resorting to conventional mediation in the event of a dispute.

The fact that the member makes an immediate purchase of a service or product in-store implies full acceptance and adhesion to these General Terms and an obligation to pay for the ordered services, which is expressly acknowledged by the member who renounces, in particular, to rely on any contradictory document, which would be unenforceable against Shala Omm. These General Terms and the rates of which the member acknowledges having been informed constitute the entirety of the agreements binding the parties as to their subject matter and their effects. These General Terms may be subject to subsequent modifications, and the version applicable to the member’s purchase is the one in effect on the day the contract is concluded.
